1.1 These Terms & Conditions (T&Cs) of Paul von Malottky (referred to as "Provider") apply to all contracts for participation in online live courses and the provision of digital content (referred to as "Services") concluded between the Provider and a consumer or business (referred to as "Customer"). Conflicting terms from the Customer are excluded unless explicitly agreed otherwise.
1.2 A business is defined as a person or entity acting in a commercial or professional capacity. A consumer is any person entering into a transaction primarily for personal, non-commercial purposes.
1.3 Digital content refers to data produced and provided in digital form.
2.1 The Provider delivers services through qualified personnel and may engage subcontractors. Customers are not entitled to request specific personnel unless otherwise agreed.
2.2 Services are provided with care, but specific outcomes or learning results are not guaranteed, as these depend on the Customer's personal effort.
3.1 The descriptions of Services on the Provider’s website do not constitute binding offers. The Customer submits a binding offer by completing the online form.
3.2 By submitting the form, the Customer makes a binding contractual offer.

The contract is concluded when one of these actions occurs. If the offer is not accepted within five days, it is considered rejected.
3.4 The Provider stores the contract text and sends it to the Customer after the contract is concluded via email.
3.5 Customers can correct their entries at any time before submitting the offer using the available correction functions on the form.
3.6 The contract is concluded exclusively in english unless otherwise agreed.
3.7 The Provider will typically contact the Customer via email. The Customer must ensure they can receive emails, especially by adjusting spam filters accordingly.

6.1 The Provider retains all rights to the provided content.
6.2 Educational materials are provided electronically unless otherwise agreed.
6.3 Customers may not reproduce or distribute any content without explicit permission from the Provider.

8.1 The Provider is liable without limitation for intent, gross negligence, or injury to life, body, or health.
8.2 For other breaches, liability is limited to foreseeable damages typical of the contract.
8.3 Further liability is excluded unless required by law.
